We’ve been using California’s apportionment statutes (4663, 4664) since April 19. 2004. But subtle interpretations continue to evolve. This webinar explored who has the burden of proof, what “substantial evidence” really means, apportionment to pre-existing nonindustrial causes, risk factors, genetics and industrial treatment, and much more. Don Barthel discussed the fine points of all that is apportionment in our post-SB 899 world.
