Summary of California Workers Compensation Jurisdiction and Sports Injury Cases

Generally the California workers’ compensation law applies to all industrial injuries occurring within the state. It also may apply to an injury occurring out of state if the contract of employment was made in California. Labor Code Section 3203, 3600.5, 5305. The California workers’ compensation law applies to injuries or death occurring outside California when the contract of employment was made in California. Labor Code Section 5305; Janzen vs. WCAB (1997), 61 Cal. App. 4th 109; 63 Cal. Comp. Cases 9. This rule applies whether the employee is a resident or a nonresident of California. Labor Code Section 3600.5(a); Alaska Packers Association vs. IAC (1934), 1 Cal. 2d 250.
